Andrew Bousfield acts for the CPS on POCA proceedings against Stephen Bear for Revenge Porn offences
05 April 2024Andrew Bousfield appeared for the Crown in the widely reported POCA proceedings against Stephen Bear for “revenge porn” offences in relation to Georgia Harrison.
Unusually, Ms Harrison had obtained over £200,000 damages in the civil courts, however she could not afford to enforce those damages. Andrew argued that the Crown Court should not leave Ms Harrison without a remedy if she could not afford Rolls Royce justice in the High Court.
Judge Morgan agreed and recognised there was no authority on awarding both compensation and confiscation.
In the end, Judge Morgan agreed with the Crown in the circumstances and awarded full confiscation of the benefit, and £5000 in compensation.
