The Hungarian Judicial Authority sought the extradition of BN in order that he serve a sentence of eighteen months’ imprisonment. Although the Judicial Authority asserted that BN was a fugitive, he had in fact remained in Hungary for some time after the offending was alleged to have occurred. Eventually he was convicted in his absence.
On 19 July District Judge McGarva handed down judgment in which he ordered BN’s discharge. Having heard from BN, a psychiatrist, and an independent social worker, the District Judge found that BN was not a fugitive, and that extradition would be a disproportionate interference with the family and private life of BN and his family.
