The Claimant, Mr Choksi, an India businessman, wanted by the Government of India to be tried for economic crimes and presently in custody awaiting extradition in Belgium alleges that, on 23 May 2021, Gary Summers’ clients the second and fourth defendants at the behest of the Indian Government arranged his kidnapping and abduction by yacht from Antigua to Dominica during which time he was beaten by other alleged conspirators.
The Security for Costs Order in relation to the State immunity and Jurisdiction challenges was granted by the High Court’s King’s Bench Division on 13 February 2026 following a detailed application which was carefully assessed. The Claimant is required to give security for the Second and Fourth Defendants until the final disposal of the Preliminary/Jurisdiction Applications, including any appeal by paying the sum of £425,000 into the Court Funds Office by early April 2026.
