Joey Kwong was instructed to defend a privately funded client at Stevenage Magistrates' Court, where the client faced an allegation of harassment causing fear of violence from his ex-wife during an acrimonious divorce.
Working closely with his instructing solicitor, Joey pursued multiple disclosure requests, section 8 applications, and an application for wasted costs.
Despite the Prosecution's late attempts to remedy disclosure failings, Joey successfully argued that the proceedings amounted to an abuse of process, with the court granting a stay of the prosecution at trial, bringing the case to an end.
The wasted costs application was also successful, resulting in the client recovering the majority of his legal expenses.
