Prosecution offer no evidence after cross-examination by Adam Kirke


Adam Kirke represented a client charged with aggravated stalking. Adam’s client accepted a large proportion of the Crown’s case against them, albeit offered their own interpretation on the conduct suggesting that the behaviour was in pursuit of a legitimate aim (namely recovering a large debt) and that any adverse behaviour was, in any event, ‘part and parcel’ of the relationship as a whole. There were also concerns in relation to the causation of serious alarm or distress and whether this was pre-existing at the time.

Following extensive cross-examination of the complainant in relation to various WhatsApp and social media messages which not only supported the Defendant’s account, but raised serious issues in relation to credibility, the Crown offered no evidence after cross-examination and before the end of their case.
