Stefan Hyman successfully defends Hungarian extradition case


Stefan Hyman won a Hungarian extradition case when District Judge Minhas concluded that there was no dual criminality with English law. She found that the conduct described in the Arrest warrant was a substantive offence of money laundering in which the requested person’s acts took place outside the requesting State. Following the Supreme Court’s decision in El Khouri v Government of the United States of America [2025] UKSC 3, a substantive offence of money laundering is not extraterritorial where a requested person’s conduct takes place outside the UK. Despite the suggestion that the conduct could be characterised as a conspiracy, the Hungarian judicial authority did not appeal.
