Jonathan Swain secures discharge on Irish extradition request for historic burglary

Jonathan Swain successfully represented a requested person whose extradition was sought by the High Court in Dublin, Ireland, to be prosecuted for a single offence of Burglary in 2013.

Jonathan argued that the extradition of the requested person would be contrary to Article 8 of the European Convention on Human Rights, with a particular focus on the impact on his wife and their two young children.

Much of the argument focussed on one of his children who is showing signs of communication difficulties. Expert evidence demonstrated the potential devastating impact on her in the event of her father’s extradition.

The Judicial Authority are not appealing the case.
